통상임금·가산수당이란?
통상임금은 연장·야간·휴일근로수당 등을 산정하는 기준이 되는 시급입니다. 근로기준법 제56조에 따라 법정근로시간을 초과하거나 야간·휴일에 근무하면 통상시급에 가산율을 적용한 수당을 지급해야 합니다.

연장+야간이 겹치면 수당은 어떻게 계산되나요? — 실제 숫자로 검산
연장근로가 야간(22시~06시) 시간대에 이뤄지면 연장가산(50%)과 야간가산(50%)이 중복 적용되어, 해당 시간에 대해 통상시급의 100%(50%+50%)가 추가로 가산됩니다. 즉 그 시간에 대해 지급되는 총액은 통상시급의 2배(200%)에 해당합니다.
월 통상임금 300만원(위 계산기 기본값)을 예로 들어 검산해보면: 통상시급 = 300만원 ÷ 209시간 ≈ 14,354원. 연장근로 3시간이 모두 야간 시간대에 이뤄졌다고 가정하면, 연장수당 = 14,354원 × 1.5 × 3시간 = 64,593원(통상임금분 포함), 야간수당(가산분만) = 14,354원 × 0.5 × 3시간 = 21,531원입니다. 두 가산분을 더하면 64,593원 + 21,531원 = 86,124원으로, 이는 그 3시간 동안 통상시급의 100%가 추가로 가산되었음을 보여줍니다.
휴일근로 10시간을 근무한 경우도 함께 검산해보면: 8시간 이내분은 통상시급의 150%(가산 50%)가 적용되어 14,354원 × 1.5 × 8시간 = 172,249원, 8시간을 초과한 2시간분은 통상시급의 200%(가산 100%)가 적용되어 14,354원 × 2 × 2시간 = 57,416원이 됩니다. 두 구간을 더하면 172,249원 + 57,416원 = 229,665원이 휴일수당 총액으로 계산되며, 이는 8시간을 기준으로 가산율이 달라지는 구조를 그대로 보여줍니다.
통상시급 계산에 쓰이는 209시간은 주 40시간 근무에 유급 주휴시간 8시간을 더한 주 48시간에, 1개월의 평균 주수(약 4.345주)를 곱해 산정하는 근로기준법상 표준 월 소정근로시간입니다. 위 계산기는 이 209시간을 기준으로 '월 통상임금 ÷ 209시간'을 계산해 통상시급을 구합니다.
통상임금 산정 범위는 기본급 외에도 정기적·일률적·고정적으로 지급되는 수당이 포함될 수 있는지에 따라 사업장마다 다르게 판단될 수 있어, 실제 통상임금 범위는 근로계약서·취업규칙과 고용노동부 지침을 함께 확인해야 정확합니다. 또한 상시근로자 5인 미만 사업장은 근로기준법 제56조(연장·야간·휴일근로 가산수당)의 적용이 제외되어, 법적으로는 가산수당 지급 의무가 없을 수 있습니다(다만 근로계약이나 취업규칙에서 별도로 정한 경우는 그에 따릅니다). 정확한 적용 여부는 고용노동부 또는 노무사의 확인을 받으시기 바랍니다.
What is ordinary wage and overtime pay?
Ordinary wage is the hourly base used to compute extended, night, and holiday work pay. Under Article 56 of the Labor Standards Act, hours beyond statutory limits or at night/on holidays require a premium on top of the ordinary hourly wage.
Premium rates (2026)
- Extended hours: +50%. Night hours (10pm-6am): +50%. Holiday work up to 8h: +50%. Holiday work beyond 8h: +100%.
Overlapping premiums
Extended hours worked at night can trigger both the extended and night premiums. This tool computes each item separately — add both for overlapping periods.
How overlapping extended and night hours are paid — a worked check
When extended (overtime) work falls within night hours (10pm–6am), both the extended premium (50%) and the night premium (50%) apply, adding a combined 100% premium on top of the ordinary hourly wage for those hours — effectively 200% total pay for that time.
Using the calculator's default of a 3M KRW monthly ordinary wage: hourly wage = 3M ÷ 209 ≈ 14,354 KRW. If 3 extended hours fall entirely within night hours: extended pay = 14,354 × 1.5 × 3 = 64,593 KRW (includes base pay), and night pay (premium only) = 14,354 × 0.5 × 3 = 21,531 KRW. Combined, 64,593 + 21,531 = 86,124 KRW — showing a full 100% premium was added for those 3 hours.
Checking 10 hours of holiday work: the first 8 hours get 150% of the hourly wage (50% premium) = 14,354 × 1.5 × 8 = 172,249 KRW, and the remaining 2 hours get 200% (100% premium) = 14,354 × 2 × 2 = 57,416 KRW. Together, 172,249 + 57,416 = 229,665 KRW in total holiday pay, illustrating exactly how the premium rate changes at the 8-hour mark.
The 209 hours used to derive the hourly wage is the Labor Standards Act's standard monthly working hours: 40 weekly hours plus 8 paid weekly-rest hours = 48 hours/week, multiplied by the average weeks per month (about 4.345). The calculator uses this 209-hour figure for "monthly ordinary wage ÷ 209 hours."
The scope of ordinary wage can vary by workplace depending on which allowances are paid regularly, uniformly, and at a fixed amount — check your employment contract, work rules, and labor ministry guidance for the exact scope. Workplaces with fewer than 5 regular employees are exempt from Article 56 of the Labor Standards Act (extended/night/holiday premiums), so there may be no legal obligation to pay these premiums (unless the employment contract or work rules provide otherwise). Confirm applicability with a labor authority or attorney.
통상임금의 범위와 포괄임금제 — 가산율보다 중요한 것
가산율은 법에 고정돼 있어 다툴 여지가 없습니다. 실제로 금액이 갈리는 지점은 통상임금을 얼마로 보느냐입니다. 통상시급이 잘못 잡히면 가산율을 정확히 적용해도 결과는 틀립니다.
무엇이 통상임금에 들어가나
통상임금은 소정근로의 대가로 정기적·일률적으로 지급하기로 정해진 금액입니다. 판단 기준은 명칭이 아니라 성격입니다. 수당 이름이 무엇이든 정기성·일률성·고정성을 갖추면 통상임금에 들어갑니다.
정기성은 일정한 간격을 두고 계속 지급되는 것을, 일률성은 모든 근로자나 일정한 조건을 갖춘 모든 근로자에게 지급되는 것을 뜻합니다. 고정성은 추가 조건 없이 확정적으로 지급되는 것을 말합니다. 기본급, 직책수당, 자격수당, 매달 같은 금액이 나오는 식대가 대체로 여기 해당합니다.
반대로 실적에 따라 금액이 달라지는 성과급, 특정한 날에 재직 중인 사람에게만 주는 명절상여금처럼 지급 여부가 불확실한 것은 고정성이 없어 제외됩니다. 연장·야간·휴일근로수당 자체도 소정근로의 대가가 아니라 통상임금에 넣지 않습니다.
통상시급을 구하는 방법
월급제 근로자의 통상시급은 월 통상임금을 월 소정근로시간으로 나눈 값입니다. 주 40시간을 일하는 경우 월 소정근로시간은 주휴시간까지 포함해 209시간으로 환산합니다. 주 40시간에 주휴 8시간을 더한 48시간에 연간 주수를 곱해 12로 나눈 값입니다.
여기서 흔한 오류가 나옵니다. 주휴시간을 빼고 174시간으로 나누면 통상시급이 높게 나오고, 반대로 연장근로시간까지 분모에 넣으면 낮게 나옵니다. 어느 쪽이든 가산수당 계산이 틀어집니다.
격주 근무나 교대제처럼 소정근로시간이 주마다 다르면 4주 평균으로 환산합니다. 단시간 근로자도 같은 방식으로 자기 소정근로시간을 기준으로 계산합니다.
포괄임금제라도 무조건 유효하지는 않습니다
연장근로수당을 미리 월급에 포함해 지급하기로 정하는 포괄임금 약정은, 근로시간을 정확히 산정하기 어려운 사정이 있고 근로자에게 불이익하지 않을 때만 유효합니다. 사무직처럼 출퇴근 기록으로 근로시간을 셀 수 있는 직무라면 산정이 어렵다고 보기 어렵습니다.
유효한 약정이더라도 실제 일한 시간에 대한 법정수당이 약정 금액보다 많으면 차액을 지급해야 합니다. 포괄임금이라는 이유로 초과분을 주지 않는 것은 임금체불입니다.
약정에 몇 시간분의 연장근로수당이 포함돼 있는지 명시돼 있지 않으면 다툼이 생겼을 때 회사가 불리해집니다. 근로계약서에 고정연장근로시간과 그에 해당하는 금액이 구분돼 적혀 있는지 확인해 두는 편이 낫습니다.
5인 미만 사업장과 근로시간 한도
상시 근로자 5인 미만 사업장에는 가산수당 규정이 적용되지 않습니다. 연장근로를 해도 통상임금의 100%만 주면 되고 50% 가산분은 법적 의무가 아닙니다. 야간·휴일근로도 마찬가지입니다. 다만 최저임금, 주휴수당, 퇴직금은 5인 미만에도 적용됩니다.
5인 이상이면 연장근로는 당사자 합의로 주 12시간까지만 가능합니다. 법정 근로시간 40시간과 합쳐 주 52시간이 상한입니다. 이를 넘기면 수당을 지급했더라도 별도로 법 위반입니다.
상시 근로자 수는 사업장 단위로 세되, 산정 기간 동안의 연인원을 가동일수로 나눠 계산합니다. 아르바이트나 기간제 근로자도 포함되고 대표자와 동거 친족은 빠집니다. 5인 언저리라면 이 계산에 따라 적용 여부가 달라집니다.

Ordinary wage and inclusive pay — what matters more than the premium rate
The premium rates are fixed by statute. What actually moves the number is how the ordinary wage is defined — get the hourly base wrong and the correct premium still gives the wrong answer.
What forms part of the ordinary wage
The ordinary wage is what is contractually payable for contracted work on a regular and uniform basis. Substance governs, not the label: any allowance that is regular, uniform and fixed belongs in it.
Regular means paid at set intervals; uniform means paid to all workers or all who meet a stated condition; fixed means payable without further contingency. Base pay, position and qualification allowances, and a constant monthly meal allowance typically qualify.
Performance pay that varies with results, or holiday bonuses paid only to those employed on a given date, lack fixity and are excluded — as are overtime, night and holiday premiums themselves.
Converting to an hourly figure
For monthly-paid workers the hourly ordinary wage is the monthly ordinary wage divided by monthly contracted hours. On a 40-hour week that comes to 209 hours, including paid weekly holiday hours.
Two common errors follow: dividing by 174 hours by omitting the weekly holiday inflates the rate, while including overtime hours in the denominator deflates it.
Where contracted hours vary — alternating weeks or shift patterns — convert using a four-week average. Part-time workers use their own contracted hours the same way.
Inclusive pay agreements are not automatically valid
An inclusive pay agreement that folds overtime into monthly salary is valid only where hours are genuinely hard to measure and the worker is not disadvantaged. Office roles with attendance records rarely meet that test.
Even a valid agreement does not cap liability: if statutory premiums for hours actually worked exceed the agreed amount, the difference is payable, and withholding it is unpaid wages.
Agreements that do not state how many overtime hours the sum covers tend to fail in dispute. Check whether the contract separates the fixed overtime hours and the amount attributed to them.
Small workplaces and the hours cap
Workplaces with fewer than five regular workers are outside the premium provisions: overtime need only be paid at 100% of the ordinary wage, and the same applies at night and on holidays. Minimum wage, weekly holiday pay and severance still apply.
At five or more, overtime by agreement is capped at 12 hours a week, giving a 52-hour ceiling. Exceeding it is a breach in itself, regardless of whether premiums were paid.
Headcount is measured per workplace, dividing total person-days by operating days. Part-time and fixed-term workers count; the proprietor and cohabiting relatives do not.
