A brokerage fee is the commission paid to a licensed real-estate agent for arranging a sale or lease. Statutory caps set both a rate by amount bracket and, for smaller deals, a fixed cap; the actual fee is negotiated within that ceiling.
Converting lease deposits
For a lease with monthly rent, the applied amount is deposit + (rent × 100). If that converted figure is under 50,000,000 KRW, it is instead deposit + (rent × 70).
Rate table (2026, housing)
Rates range from 0.3%–0.7% depending on amount and transaction type, with fixed caps applied below roughly 200,000,000 KRW.
Working out the brokerage transaction value
The rate table is the easy part. The friction is elsewhere: converting a monthly-rent contract into a transaction value, whether the rates are fixed or capped, and whether VAT is included.
Non-residential property
Commercial units, officetels and land fall under a single cap regardless of sale or lease. Officetels of 85㎡ or less with a private kitchen and bathroom are treated as residential, with separate caps of 0.5% for sale and 0.4% for lease.
Working out the transaction value
For a sale, the transaction value is simply the price. Leases are trickier: a jeonse deposit is the value as-is, but a monthly-rent contract must be converted into a single figure — deposit plus 100 times the monthly rent.
If that figure falls below 50 million KRW, recalculate using a multiplier of 70. A contract with a 5 million deposit and 400,000 monthly rent first gives 45 million, which is under the threshold, so it becomes 5 million + 28 million = 33 million KRW.
Contracts with large deposits often land near a band boundary, so it is worth checking the converted figure directly.
Where disputes actually arise
- VAT is not included in the caps. A general-taxpayer agent adds 10%; a simplified taxpayer cannot charge it.
- Ordinances differ by municipality. This table follows the Seoul ordinance; other regions may set slightly different bands.
- The cap amounts are easy to miss. In the lower bands a fixed cap applies alongside the rate, and the lower of the two governs.
- A cancelled contract does not always cancel the fee. If the contract falls through for reasons unrelated to the agent, a claim for the fee may still stand.
