What is dismissal notice pay?
An employer must give at least 30 days' notice before dismissing a worker, or else pay at least 30 days of ordinary wages (Labor Standards Act Art. 26). This also applies to dismissals for managerial reasons.
Daily ordinary wage is hourly ordinary wage times daily contracted hours; monthly pay is divided by 209 hours to get the hourly wage.
What if notice was under 30 days?
The statute requires at least 30 days of pay when notice was not given 30 days ahead. The Ministry of Employment and Labor treats any shortfall as no notice, so the rule is the full 30 days. This tool therefore computes all 30 days whenever notice is 29 days or fewer.
